RICHMOND, VA (WWBT) -

A judge sentenced a former Henrico Sheriff deputy to ten years in prison on Friday for a deadly hit and run in Richmond.

Eight of the ten years of Barry Mallory's sentence were suspended, meaning he will only have to serve two years. He will also have to pay $5,000 to help cover the burial costs of William Teets and cannot drive for the next year.

The Chesterfield man was found guilty of killing Teets in January on Chamberlayne Avenue. Teets was crossing the road, when Mallory hit him and sped off. Mallory returned to the scene 45 minutes later and was pulled over by police.

According to Henrico Sheriff Michael Wade, Mallory was once a deputy with the Henrico Sheriff's Office and left the department under questionable circumstances 15 years ago.

Police and prosecutors have been unable to locate Teets' next of kin.
