LAKE CHARLES, La. (KPLC) -

A hearing set for Friday in the Felix Vail case has been canceled, while the Third Circuit Court of Appeals decides how the case should move forward.

Vail, 74, is set to stand trial for the 1962 death of his wife Mary Horton.

Judge Robert Wyatt ruled in March that the disappearances and presumed deaths of two other women -- Vail's girlfriend Sharon Hensley and his second wife Annette Craver -- can be used in the case.

Vail's defense attorney objected to the ruling.

The Third Circuit Court says it wants to hear from both sides in the case before making a decision on whether to allow the evidence into trial.

That hearing is set for September 24.
