FAIRFIELD, CA (CNN) -

A father in California wants a restraining order against his son's alleged bully-- a nine-year-old.

His son is in the 4th grade and says he's being terrorized by a classmate.

"He came up and pushed me, I pushed him and he punched me in the face and he said haha, you got punched."

The dad says the harassment has gone on for five months and the school isn't stopping it.

That's why he says he had no choice but to go for a restraining order against a 9-year-old boy.

Stephen Fuedner only has a first name of the child, he doesn't know the last name because he says the school won't release it.

The school district says it can't hand over the child's information because it's confidential.
