A man is accused of trying to steal a cell phone, then killing a dog after he entered a home.

The Calcasieu Parish Sheriff's Office says 26 year old Joel Benito of Lake Charles asked to borrow the cell of a man standing on Cedar Lane in Moss Bluff.

Deputies say Benito tried to steal the phone, but failed, and instead fled into a near-by home on Champagne Circle.

Investigators say Benito attacked one of the dogs in the home, cutting it severely. The dog was later put down.

Deputies arrested Benito, but while in the patrol car he kicked out a window despite his hands and feet being shackled.

He was taken to a local hospital for his own safety.

Once discharged from the hospital he will be booked in the Calcasieu Correctional Center and charged with aggravated burglary; aggravated cruelty to an animal; aggravated criminal damage to property; and attempted theft.
