Mom sought in Amber Alert arrested on felony charges

TEMPE, AZ (CBS5) -

An Amber Alert for a 21-month-old child lasted for about three hours Thursday afternoon before police were able to catch the boy's mother.

The child, Javison Mosley, was found safe, DPS said.

Authorities said Olivia Mosley fled with Javison from Sunrise Preschool at 808 E. Minton after learning Child Protective Services was going to take custody of him.

According to the police report, Mosley met with CPS about 2 p.m. Thursday and was told that her son would be removed from her custody.

Mosley originally lost custody in January 2012 after making suicidal and homicidal statements. She regained physical custody of her son in April of 2013, but CPS maintained legal custody over the boy, the police report said.

A CPS case worker made the decision to remove the boy from her custody on Thursday because of her mental illness which she was refusing treatment for, according to the worker.

Police said Mosley left the CPS office and CPS called Sunrise Preschool, asking the staff not to release her son to her.

About 2:25 p.m. Thursday, Mosley arrived at the daycare and got into a fight with daycare staff, before fleeing with the child in a 1994 maroon four-door Lexus with Arizona license plate BCD4654, Tempe police said. Police said the child was unrestrained in the front passenger seat.

Police warned the woman was considered a danger to herself and others, because she suffers from mental illness and had not been taking her prescribed medication. Officers said they have dealt with her before.

Mosley returned to her home about 5:45 p.m. Thursday which was being monitored by police. She was arrested after a brief struggle, police said.

Police said Mosley refused to speak with police and asked to speak with her attorney.

Mosley faces one felony count of custody interference and one count of endangerment.
