BATON ROUGE, LA (WAFB) -

Judge Tim Kelly has set Oct. 15 as the trial date for a school voucher lawsuit.

A lawsuit filed by the Louisiana Federation of Teachers, Louisiana Association of Educators and the Louisiana School Board Association seeks to declare the voucher program unconstitutional.

The statewide voucher program will use tax dollars to allow kids to go to private and parochial schools.

Just last week, the same three groups lost a lawsuit to block the adoption of the voucher plan.

The state argued the judge did not have the jurisdiction to do that and Kelly agreed.

As of now, the first vouchers are scheduled to go out around the first week in August.
