No refusal law challenged by attorneys

LAKE CHARLES, LA (KPLC) - A group of attorneys has filed a lawsuit challenging the so-called no refusal procedure.

It's used to force people to provide a blood sample when police believe a driver is under the influence of drugs or alcohol.

So far the court has refused to stop police from following new procedures-- which involve getting a search warrant from out in the field and forcing suspects to have blood drawn.

There was a hearing today before Judge Kent Savoie. Both sides were asked to provide more information on the status of the law in other areas within ten days.

Then the court is expected to rule on various issues related to the suit.

Law enforcement agencies named in the suit include the DA's Office, Calcasieu Sheriff's Office, Lake Charles Police and Westlake Police Department.
