LAKE CHARLES, LA (KPLC) - A Texas man has been arrested for attempted first degree murder, drunk driving and other charges after attempting to fight a State Trooper during a DWI test.
Louisiana State Police report that a trooper assigned to Troop D conducted a traffic stop on Common St. on February 1, 2019 just after 5:00 a.m.
At the traffic stop the trooper conducted a routine field sobriety test on the driver, Julio R. De Los Rios, 25, of Donna, Texas. While the trooper was conducting the sobriety test De Los Rios became combative and started to fight the trooper.
During the fight the trooper discharged his firearm which did not hit De Los Rios.
De Los Rios was arrested without injury and transported to Troop D for processing. The Trooper arresting De Los Rios was transported to a local hospital for treatment.
Upon arrival at Troop D, De Los Rios refused to provide a toxicology sample. A on-call judge was then contacted who approved a “no refusal” search warrant which allowed troopers to obtain blood samples from De Los Rios without his consent.
De Los Rios has been booked into the Calcasieu Correctional Center for attempted first degree murder of a police officer, resisting an officer by force, second degree battery, DWI second offense, and improper turning at an intersection. His bond has been set at $115,000.
State Police report that the Lake Charles Police Department and the Calcasieu Parish Sheriff’s Office assisted with the incident and the investigation is ongoing.
